A federal judge on Wednesday refused a federal court's order that Canadian doctors who used to practice legally prescribed Viagra be permitted to practice in Alberta.
The order, ordered by the federal court in Edmonton, requires the provincial government to reimburse the province for all costs incurred in the province’s health care system, including:
Medicare for Ontarians
Ontario Health Services
Ontario’s General Health Services
General practitioner services
The order also requires the provincial government to reimburse the province for “unnecessary and unnecessary expenses” related to the use of the Canadian-made prescription drugs.
The Alberta Court of Appeal upheld the decision on the appeal of the federal court.
In a separate order issued by the federal court, Alberta’s health minister said Health Canada was aware of the decision but declined to comment further.
“The government has a responsibility to make a decision that is appropriate and in accordance with the law,” Health Canada said in a statement.
In a decision, the federal court said Alberta was “committed to ensuring that patients in Alberta receive the best quality and services at their own convenience.”

“The Court of Appeal unanimously holds that Health Canada has no jurisdiction to reimburse Health Canada for the cost of the medication that was reimbursed by Health Canada. Health Canada is aware of the decision of the Alberta Court and has reviewed the facts before it. Health Canada is aware that there are significant differences between the provincial and territorial health systems regarding the reimbursement of medications.”
In its decision, Health Canada said it had received “multiple” submissions from individual patients who had been prescribed Viagra. It said the Canadian doctors who had been prescribed Viagra had to have a private prescription to treat impotence, which could include Viagra-based medications.
It said its review of the case concluded that Health Canada had “no jurisdiction” to reimburse Health Canada for the cost of the medication that was reimbursed by Health Canada.
“The cost of the medication is reimbursed by Health Canada, and Health Canada does not have jurisdiction to reimburse. This is a matter for a different court.”
